These Terms & Conditions govern the use of the Hyper Local SA website, business directory, member accounts, subscriptions and related services.
Hyper Local SA is owned and operated by Sublime Group (Pty) Ltd and provides an online platform designed to connect customers with businesses, products and services throughout South Africa.
By accessing Hyper Local SA, creating an account, purchasing a subscription, submitting a business listing or otherwise using the platform, you agree to these Terms & Conditions.
1. About Hyper Local SA
Hyper Local SA is an online South African business directory that allows businesses to create and manage listings and allows members of the public to search for businesses, products and services.
Hyper Local SA provides the platform through which businesses and customers can discover and contact one another. Hyper Local SA is not a party to transactions, agreements or arrangements concluded between users and listed businesses.
2. User Accounts
Certain features require you to create a registered member account.
When creating or using an account, you agree to:
- Provide accurate and current information.
- Keep your login details secure.
- Accept responsibility for activity conducted through your account.
- Notify Hyper Local SA if you become aware of unauthorised access to your account.
- Update your information when your details change.
You may not impersonate another person or business or create a business listing without the authority of that business.
Hyper Local SA may suspend or terminate accounts that breach these Terms & Conditions.
3. Business Listings
Registered businesses may create and manage business listings through their member dashboard.
Information submitted for a listing may include company information, contact details, descriptions, services, products, images, website addresses, social media details and location information.
You are responsible for ensuring that information submitted to Hyper Local SA is accurate, lawful, current and not misleading.
Hyper Local SA reserves the right to edit, reject, suspend or remove listings that:
- Contain false or misleading information.
- Infringe intellectual property rights.
- Contain unlawful, defamatory, offensive or inappropriate material.
- Promote prohibited products, services or activities.
- Breach applicable South African laws.
- Breach these Terms & Conditions.
4. Subscriptions and Payments
Some Hyper Local SA business listing services require a paid subscription.
Subscription fees, billing periods and features are displayed when selecting a subscription plan or completing an order.
By purchasing a subscription, you agree to pay the applicable fees associated with your selected plan.
Subscriptions may renew automatically according to the billing period of the selected plan unless cancelled before the next renewal date.
Subscriptions may be cancelled through the available member or directory dashboard where this functionality is provided.
Unless specifically stated otherwise at the time of purchase, cancellation prevents future renewal and does not automatically entitle the account holder to a refund for a subscription period already paid.
5. No Long-Term Contract
Where a Hyper Local SA subscription is advertised as having no long-term contract, this means you may cancel the recurring subscription and are not required to continue renewing it for an additional subscription period.
You remain responsible for fees already incurred before cancellation.
6. Featured and Promoted Listings
Hyper Local SA may offer Featured Listings, promoted positions, advertising campaigns or other paid visibility services.
Featured or promoted businesses may appear more prominently than standard listings or receive additional exposure on the platform.
The purchase of a Featured Listing, advertising service or promotional campaign does not guarantee enquiries, leads, sales, website traffic or any particular commercial result.
7. Business Responsibility
Businesses listed on Hyper Local SA operate independently from Hyper Local SA.
Each business is responsible for its own:
- Products and services.
- Prices and quotations.
- Customer service.
- Licences, registrations and professional requirements.
- Guarantees and warranties.
- Advertising claims.
- Transactions with customers.
- Compliance with applicable legislation.
A listing on Hyper Local SA does not automatically mean that Hyper Local SA endorses, certifies, recommends or guarantees that business.
Users should conduct their own checks before purchasing products, appointing service providers or entering into agreements with businesses found through the platform.
8. User Content
You may be permitted to submit content including text, photographs, graphics, logos, business information, reviews and website links.
You confirm that you own this content or have the necessary permission to publish and use it.
You may not submit content that infringes another person’s copyright, trademark, privacy, intellectual property or other legal rights.
By submitting content to Hyper Local SA, you grant Sublime Group (Pty) Ltd permission to display, reproduce, adapt and use that content as reasonably required to operate, promote and maintain Hyper Local SA and its business directory.
9. Reviews and Public Contributions
Where reviews, ratings, comments or other public contributions are available, users must provide genuine information based on their own experience.
Users may not submit:
- Fake or fabricated reviews.
- Reviews intended to deliberately harm a business.
- Defamatory or unlawful statements.
- Threatening, abusive or discriminatory content.
- Spam or promotional content disguised as a review.
- Content submitted in exchange for an undisclosed incentive where disclosure is legally required.
Hyper Local SA may moderate, edit or remove user-generated content where reasonably necessary.
10. Prohibited Use
You may not use Hyper Local SA to:
- Commit or facilitate unlawful activity.
- Misrepresent yourself or another business.
- Publish false or misleading information.
- Send spam or unsolicited bulk communications.
- Introduce malware, malicious code or harmful software.
- Attempt to gain unauthorised access to the website or another user’s account.
- Scrape, harvest or automatically extract directory information without permission.
- Copy or commercially exploit Hyper Local SA’s database or website content without permission.
- Interfere with the security or normal operation of the platform.
- Infringe the rights of Hyper Local SA or any third party.
11. Intellectual Property
The Hyper Local SA website, branding, database, design, software and original website content are owned by Sublime Group (Pty) Ltd or used under appropriate licence.
You may use the website for its intended purpose but may not reproduce, distribute, sell, modify or commercially exploit protected Hyper Local SA material without prior written permission.
12. Third-Party Websites and Services
Hyper Local SA listings may contain links to websites, social media profiles, payment providers and other third-party services.
Hyper Local SA does not control these external services and is not responsible for their content, security, availability, products, services or privacy practices.
Accessing a third-party website or service is done at your own discretion and may be subject to separate terms and privacy policies.
13. Availability of the Platform
Hyper Local SA aims to provide a reliable online service but cannot guarantee uninterrupted or error-free access.
The website or individual features may occasionally be unavailable due to maintenance, upgrades, technical problems, hosting failures, network interruptions or circumstances outside our reasonable control.
14. No Guarantee of Results
Hyper Local SA provides businesses with an online platform to improve their visibility and help potential customers discover their products and services.
Hyper Local SA does not guarantee:
- A specific number of enquiries or leads.
- Increased website traffic.
- Search engine rankings.
- Sales or revenue.
- Customer conversions.
- Any particular business result.
Performance may differ based on location, industry, competition, listing quality, customer demand and other factors outside Hyper Local SA’s control.
15. Limitation of Liability
Hyper Local SA and Sublime Group (Pty) Ltd are not responsible for losses resulting from transactions or disputes between users and businesses listed on the platform, except where liability cannot legally be excluded.
To the extent permitted by South African law, Hyper Local SA will not be liable for indirect, incidental or consequential losses arising from the use of the platform.
Nothing in these Terms & Conditions is intended to exclude or restrict rights or remedies that cannot lawfully be excluded under applicable South African legislation.
16. Privacy and Personal Information
Personal information collected through Hyper Local SA will be handled in accordance with the Hyper Local SA Privacy Policy and applicable South African data protection legislation.
Users submitting personal information belonging to another person must have the necessary authority or consent to provide that information.
17. Account and Data Removal
Registered users may request deletion of their account and associated personal information, subject to information that Hyper Local SA may be legally required or reasonably entitled to retain.
Where account deletion functionality is available in the member dashboard, users may use this facility to initiate deletion.
Business owners may also request removal of their business listing.
18. Suspension and Termination
Hyper Local SA may suspend, restrict or terminate an account or business listing where a user:
- Breaches these Terms & Conditions.
- Fails to pay applicable subscription fees.
- Engages in fraudulent or unlawful activity.
- Misuses the platform.
- Provides materially false or misleading information.
- Creates a risk to Hyper Local SA, its users or third parties.
Termination does not remove obligations or amounts that became due before termination.
19. Changes to These Terms
Hyper Local SA may update these Terms & Conditions from time to time.
The updated version may be published on the Hyper Local SA website together with an updated revision date. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms & Conditions, subject to applicable law.
20. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute arising from the use of Hyper Local SA or these Terms & Conditions will be dealt with in accordance with applicable South African law.
21. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision may be separated from the remaining terms without affecting the validity of the remaining provisions.
